A.I. - All in packages These are packages wherein we arrange everything for you, Whether Pre-designed or customized. As long as your transportation (air flight, ferry) is also on us. L.A. - Land Arrangement These are packages wherein the client already have transportation to the place. Therefore we are going to pick you up on your drop off (airport / seaport) and take care of the rest of your travel. A.F. - Airfare / Ferry Voyage When you only need our ticketing / ferry voyage services, we can provide these for you. R.O. - Room Only These are Hotel Bookings, or Resort Room accommodation only. They usually includes Breakfast for the clients. T.O. - Tours Only We will provide for your tours only. Example of which are Bicol Tours. The client already have transportation and resort/hotel accommodation and just needs tour around the area. This will vary and be subject to availability. Not all destinations may offer this service. 4. Remarks, Notes & Terms
A. IMPORTANT REMINDERS / NOTICES
- ALL TOURS ARE PREPAID. Before travel, all accounts must be settled with Tobi's Travels.
- Always bring a VALID (Gov’t. issued) Identification Card (I.D.) OR PASSPORT with you at all times.
- International Travel: Please check in At Least 3 – 4 Hours prior to departure.
- General toiletries are provided for each guest in each room. Bring extra as needed.
- After arrival in Airport, go straight outside where all transfer representatives are lined up with placards. Look for a person with YOUR NAME or Tobi's Travels in welcome signage / placard / board with him.
- Please wait in the Hotel Lobby 5-10 minutes before actual pick up time for Tours
- During Departure, standard pick up time is 3-4 hours before flight. Your guide will advise you as to the exact or please wait in the hotel lobby for your transfer to the airport.
- For Any Cancellation/Void/Exchange/Correction or Refunds, a charge for Service Fee, Plus Hotel / Tour Coordinator charges which will be charged, Including Penalties, and Other Fees Will be billed to Your Account.
- We are not responsible for any delays, cancellation or change of schedule of flights of different airlines which may affect any onward bookings or itinerary of passengers or succeeding flights.
- Hotel & tour package is totally non-refundable once finalized even if services are not utilized.
- International Travel: Passport must be valid for at least 6 months upon departure. Passenger name in hotel and tour voucher should match the name on the passport.
- We try our best to adhere to the itinerary but please be flexible as there are some circumstances that are out of our control. Be patient.
B. CONTRACT TERMS & CONDITIONS:
1. This Contract is ongoing and binding once all payments have been settled, even if the client does not return the signed copy as long as the contract was submitted to him/her along with all the travel documents necessary. This will mean that 99% of the services of Tobi’s Travel & Tour Services Inc. have been rendered to the client as their chosen agent. The travel and tour package will now be under the terms and conditions of not only Tobi’s Travel & Tour Services Inc., but also the Airline / Ferry Company and the Hotel / Resort / Tour Operator (Provider /Suppliers) as agreed to by the Client.
2. Client requests on Rebooking and/or Cancellation – Client must advise Tobi’s Travel & Tour Services Inc. in writing aside from text, or call for any request on Rebooking or Cancellation. The Client will also pay for all rebooking fees and expect Cancellation fees as subjected to Hotel / Resort / Airline / Ferry / Tour Operator Policies and Regulations. Tobi’s Travel & Tour Services Inc. will coordinate all Rebooking or Cancellation transactions, and refund if possible to Client the remaining amount less all Rebooking and Cancellation fees. Regardless of the reason, 70% of the actual Tour amount shall be retained and forfeited in favour of Tobi’s Travel & Tour Services Inc upon cancellation aside from the Supplier’s Cancellation policy fees, whichever is higher. If the cancellation is made 24 hours to 7 days before the travel period, 100% or all payments made shall be forfeited. Miscellaneous fees such as Handling fee; Communication fee will also be considered and the exact amount is to be determined.
3. Hotel / Resort / Airline / Ferry / Tour Operator Initiates Rebooking or Cancellation – Hotel / Resort / Airline / Ferry provider will notify Tobi’s Travel & Tour Services Inc. for any changes in booking or flight schedule and in turn will notify the client about the changes and will coordinate for the re-processing transactions. All fees will be settled according to Hotel / Resort / Airline / Ferry / Tour Operator Policies and Regulations, which is usually in their own account since they initiated the Change. In case the Hotel / Resort / Airline / Ferry / Tour Operator provider did not notify Tobi’s Travel & Tour Services Inc. and proceeded with the changes, the Tobi’s Travel & Tour Services Inc. will not have responsibility regarding this matter. The Client has the right to negotiate directly with the Hotel / Resort / Airline / Ferry / Tour Operator provider on the rightful terms of settlement.
4. Refunds – All NO SHOW actions in hotel, tours or flight are non refundable as it is within the day of the trip already. All tours, meals, transfers and tickets are non refundable, except for special cases. There are conditions in which a refund may be made and it will be determined by the Hotel / Resort / Tour Operator / Airline / Ferry / Tour Operator Policies and Regulations. In case a refund is possible, the amount will be refund to Tobi’s Travel & Tour Services Inc. from the provider. Upon receipt of the refund, the company will in turn refund to the Client the amount in form of cash or rebate as agreed upon. Refund must be claimed within the allotted time or else it will be forfeited in favour of the company.
5. Any incidental or additional charges that will arise during the tour which are not indicated in the contract will be the responsibility of the Client and will not hold Tobi’s Travel & Tour Services Inc., liable for any circumstances.
6. A representative of the group, even if not one of the travelling party, will be hereto referred to as the “Client”. He has the following responsibilities: to accept the terms and conditions on behalf of himself and any travel companions; to pay us for all guests in the booking; to ensure that the names on all documents are correct for all guests; to inform the guests of what was booked and any changes that may arise. The guest is solely responsible for ensuring that the actual reservation corresponds with the booking made.
7. Any loss, damage or injury, INCLUDING DEATH that the client, passenger or any of the travelling party may suffer WHETHER CAUSED BY HIS / HER NEGLIGENCE, OR BY FORCE MAJEURE, while travelling, or while in, on or upon the premises of Tour destination, or that may be attributed to the acts or omission of the Client / the passengers during the contracted travel period shall be for the account and / or liability of the Client. Client is fully aware of the risks involved and hazards that may or may not be connected to this activity, including but not limited to travel risks. Client AGREES TO INDEMNIFY AND HOLD HARMLESS Tobi’s Travel & Tour Services Inc. from any and all liability, claims, demands, actions, causes of action, loss, damage or costs, including court costs attorney fees or whatsoever arising out of these circumstances.
8. Client agrees not to hold Tobi’s Travel & Tour Services Inc. liable for the failure to comply with the contract due to force majeure, labor disputes, strikes, natural calamities and other causes beyond its control. In such event, Tobi’s Travel & Tour Services Inc. shall take the responsibility of notifying the client as soon as possible as soon as circumstances may permit. The company will try to substitute arrangements of the similar standard, should it occur but there are no guarantees. Rebooking of tours due to force majeure will be subject to Hotel / Resort / Airline / Ferry / Tour Operator Policies and Regulations, in which, actual date can be requested but not guaranteed. Both parties will hereby coordinate and come into agreement. Refer to condition No. 2/3 for advice.
9. Client understands that Tobi’s Travel & Tour Services Inc. does not maintain any medical or health insurance policies for travellers. As such, he / she should review his / her own personal insurance portfolio, especially accident/medical coverage prior to travel. All participants must be in good physical condition. It will be passenger’s responsibility to ensure that he/she complies with all the passport, visa and health requirements of the country/ies that he/she intends to visit or transit in.
10. For purchased Travel (w/ Medical) Insurance from Tobi’s Travel & Tour Services Inc., the latter will coordinate all requests for utilization of the policy to the Insurance provider, provided Client gives full details and supporting documents as deemed necessary. Tobi’s Travel & Tour Services Inc. will only base actions within the parameters of the policy and according to the provider’s regulations.
11. We are hesitant to allow unaccompanied minors but if the reasons will be valid, we’ll allow it. If one of the client / traveller is under the age of 18 and without any accompanying Parent / Guardian, the Letter of Consent submitted to Tobi’s Travel & Tour Services Inc. will serve as proof that the agent will not be liable for any circumstances that the minor will suffer during the tour.
12. In case of suit against the Client by Tobi’s Travel & Tour Services Inc. for the collection of unpaid accounts, attorney’s fees, litigation costs and other expenses shall be charged to the Client.
13. The Court of Antipolo City shall have the exclusive jurisdiction to try any dispute or legal action arising between parties under this Contract.
14. IN SIGNING THIS RELEASE, THE CLIENT ACKNOWLEDGE AND REPRESENT THAT HE / SHE have read the foregoing Waiver of Liability, understand it and sign voluntarily as his / her own free act and deed; no oral representations, statements, or inducements, apart from the foregoing written agreement, have been made; He / she is at least (18) years of age and fully competent; and He / She execute this Release for full, adequate and complete consideration fully intending to be bound by same.
